1. Contract Terms
These Terms and Conditions apply to the hire and use of facilities managed by NXT Level Sport and Education Ltd, Company Number 14744385.
These Terms and Conditions, together with the customer's confirmed booking details, the NXT Level Safeguarding and Child Protection Policy, any applicable site specific requirements and any other documents expressly incorporated into the booking, form the agreement between NXT Level Sport and Education Ltd and the customer.
In these Terms and Conditions, “NXT Level”, “we”, “us” and “our” means NXT Level Sport and Education Ltd. “Customer”, “you” and “your” means the individual, organisation, club, company or other entity making the booking. “School” means the school or educational establishment at which the booked facility is located. “Facility” means the specific area, room, pitch, court, pool or other facility confirmed in your booking. “Attendees” includes your employees, coaches, contractors, participants, children, parents, carers, spectators, guests and any other person attending in connection with your booking.
By making, confirming or proceeding with a booking, you agree to comply with these Terms and Conditions.
2. Booking Details and Customer Responsibility
You are responsible for ensuring that all information supplied when making a booking is complete and accurate.
You are responsible for checking all confirmed bookings, including the dates, times, facilities, frequency and location.
You must book the actual time and Facility you require. If your booking is from 18:00 to 19:00, your right of access begins at 18:00 and ends at 19:00.
If you require access before your booked start time for setup, changing, registration, preparation, participant arrival or any other reason, that additional time must be included within your booking.
Customers and Attendees have no automatic right to enter a site before their confirmed booking time or remain onsite after it.
Where your booking is the first booking at a site, NXT Level staff will ordinarily be scheduled to arrive up to 15 minutes before the first booking to open and prepare the site. Staff arriving early does not give you or your Attendees a right to enter the site before your booked start time.
You may only use the Facility specifically identified in your booking. The fact that another facility appears vacant does not give you permission to use it.
If you use a different or additional facility without permission, NXT Level may require you to stop using it immediately and may charge the applicable hire rate for any unauthorised use.
You are responsible for checking your own booking schedule. NXT Level is not responsible for identifying dates on which you may not wish to attend.
This includes school holidays, half terms, Christmas, Easter, summer holidays, bank holidays, religious festivals, tournaments, participant holidays and any other periods during which you may not require your usual booking.
If you do not require a booking, you must cancel it in accordance with Section 4. Unless NXT Level confirms otherwise in writing, a booking remains active and chargeable simply because you choose not to attend.
3. Charges and Payment
You must pay the charges confirmed by NXT Level for your booking.
Unless otherwise agreed, recurring monthly invoices will normally be generated around the middle of each month for bookings taking place during the following month.
Invoices must be paid in full by the 1st of the relevant booking month, unless alternative payment terms have been agreed by NXT Level in writing.
One off or short notice bookings may require payment in advance.
You are responsible for checking invoices when received and notifying NXT Level promptly of any genuine discrepancy.
If an invoice or other amount owed to NXT Level becomes overdue, we may suspend your account, refuse access to any NXT Level managed Facility and suspend future bookings until outstanding amounts have been settled.
Suspension of access because of non payment does not automatically cancel the underlying bookings or remove amounts already properly due.
Where legally permitted, NXT Level reserves the right to charge interest and reasonable recovery costs in relation to overdue commercial debts.
4. Cancellation Policy
Unless NXT Level agrees otherwise in writing, customers must provide at least 14 clear days' notice to cancel or reduce a booking.
A request to move a booking to another date, reduce its duration or remove part of a recurring booking will ordinarily be treated as cancellation of the original booking and creation of a new booking.
Where less than 14 days' notice is provided, the booking will ordinarily remain chargeable because NXT Level will have reserved the Facility, staffing and operational capacity for the customer.
Customers are responsible for cancelling bookings they do not require, including during school holidays, half terms, public holidays, personal holidays, periods of reduced participant numbers or temporary breaks in their activities. Failure to attend does not constitute cancellation.
Notice of cancellation must be provided through an approved NXT Level booking or communication channel and is not effective until received by NXT Level.
Where applicable consumer law applies, any cancellation charge will be applied consistently with the customer's statutory rights and will not exceed an amount NXT Level is legally entitled to recover.
5. Use of the Facility
Your booking grants you a temporary, non exclusive and revocable licence to use the specified Facility for the confirmed purpose and times. It does not create a lease or tenancy.
You must ensure before booking that the Facility is suitable for your intended activity.
The Facility must only be used for the purpose disclosed to and approved by NXT Level.
You must not sublet, transfer, share or commercially resell your booking without prior written permission.
You must not use any other part of the School or site merely because it is accessible or appears unused.
You and your Attendees must follow all reasonable instructions given by NXT Level staff or authorised School staff.
You are responsible for the conduct of everyone attending in connection with your booking.
6. Prohibited Items and Activities
Alcohol is not permitted anywhere onsite.
Smoking and vaping are not permitted anywhere onsite, including external grounds, car parks and entrances.
Animals are not permitted onsite, except recognised assistance dogs. Customers should notify NXT Level in advance where an assistance dog will attend so appropriate arrangements can be made.
NXT Level managed School sites operate as strict nut free allergy zones. Nuts and products containing nuts must not be brought onto the site.
You are responsible for communicating these requirements to all Attendees before they arrive.
Illegal drugs, weapons, naked flames, gas cylinders, fireworks and other dangerous or prohibited items must not be brought onto School premises.
Barbecues, cooking equipment or similar equipment may only be used where NXT Level has expressly authorised this in writing.
7. Behaviour, Noise and Neighbours
Customers and Attendees must behave respectfully towards NXT Level staff, School staff, other customers, pupils, members of the public and neighbouring residents.
Abusive, threatening, discriminatory, intimidating, aggressive or otherwise unacceptable behaviour will not be tolerated.
Noise must be kept to a reasonable level at all times.
Particular consideration must be given to neighbouring residents when arriving at and leaving the site, especially during evening and weekend bookings.
Attendees must not unnecessarily sound vehicle horns, play excessively loud music, shout outside facilities, congregate outside neighbouring properties or otherwise cause unreasonable disturbance.
Serious or repeated breaches may result in individuals being required to leave the site, bookings being suspended or future bookings being refused.
8. Parking and Vehicles
Vehicles must only be parked in designated areas and in accordance with School signage, parking restrictions and instructions from NXT Level or School staff.
Vehicles must not obstruct entrances, gates, emergency access routes, neighbouring properties or restricted areas.
Customers are responsible for ensuring their Attendees understand applicable parking arrangements.
Any parking charge, penalty or enforcement action properly imposed under the School's parking arrangements will be the responsibility of the relevant vehicle owner, driver or Customer as applicable.
NXT Level will not be responsible for parking charges incurred because an Attendee failed to comply with clearly communicated parking restrictions.
9. Safeguarding
Safeguarding is a fundamental condition of hire.
All customers must comply with the current NXT Level Safeguarding and Child Protection Policy, together with any applicable safeguarding requirements of the School.
Where children or adults at risk participate in or attend an activity, the Customer remains responsible for ensuring that appropriate safeguarding arrangements are in place for its activity.
Customers working with children must have appropriate safeguarding policies and procedures, suitable supervision arrangements and a named safeguarding lead or responsible person.
Customers must ensure that people undertaking relevant roles have the appropriate lawful DBS check for the activities they undertake, including Enhanced DBS and Children's Barred List checks where the role is legally eligible and the applicable requirements for regulated activity are met.
Customers must provide safeguarding, DBS, insurance, qualification, training, risk assessment, reference or other compliance evidence reasonably requested by NXT Level.
NXT Level may carry out compliance checks and safeguarding spot checks.
No customer has an automatic right to commence or continue child facing activity where NXT Level reasonably considers required safeguarding or compliance arrangements incomplete or inadequate.
Safeguarding concerns arising onsite must be reported immediately in accordance with the NXT Level Safeguarding and Child Protection Policy and applicable School procedures.
Where NXT Level reasonably considers there to be an immediate safeguarding risk, it may suspend or terminate the relevant activity or booking without waiting for the ordinary cancellation period.
10. Health and Safety
During your booking, you are responsible for the health and safety of your activity and Attendees.
You must conduct appropriate risk assessments and comply with applicable health and safety legislation and site requirements.
You must familiarise yourself with applicable emergency evacuation arrangements and ensure your staff understand them.
Emergency exits, fire doors and escape routes must never be obstructed.
You must immediately report accidents, injuries, hazards, damage, near misses or other significant safety incidents to NXT Level.
11. First Aid
Customers must provide suitable and sufficient first aid arrangements appropriate to their activity and Attendees.
Where qualifications are required for the activity, the Customer is responsible for ensuring appropriately qualified people are present.
Customers must have access to a working mobile telephone or other appropriate means of contacting the emergency services.
In an emergency, call 999 where appropriate before notifying NXT Level.
12. Equipment
School or NXT Level equipment must not be used unless its use forms part of the booking or NXT Level has given permission.
Equipment must not be moved unnecessarily.
Where equipment is moved with permission, it must be returned safely to its original position before the Customer leaves.
Equipment brought onsite by the Customer must be safe, appropriate and properly maintained.
Electrical equipment must comply with applicable electrical safety requirements.
Customers will be responsible for reasonable repair or replacement costs where damage is caused by them or their Attendees, subject to applicable law.
13. Condition and Cleanliness
Facilities must be left clean, tidy and substantially in the condition in which they were provided.
All rubbish, food, drink containers and other materials associated with the booking must be removed or placed in designated waste facilities.
Equipment must be returned to its appropriate location.
Where additional cleaning, staffing, repairs or security attendance is reasonably required because of a Customer's use of the Facility, NXT Level may charge the Customer the reasonable additional cost incurred.
14. Access and Security
Customers must not allow unauthorised people to enter School premises.
Doors, gates, access controls and restricted areas must not be interfered with or deliberately left unsecured.
Keys, access cards, fobs or codes supplied for an authorised purpose must not be copied, shared or provided to unauthorised people.
Customers must not enter classrooms, offices, plant rooms, storage areas or other areas outside their booking without permission.
Lost keys, access cards or other security equipment must be reported immediately.
15. School Priority and Facility Availability
Customers acknowledge that the Facilities are located within operational educational establishments.
Schools may occasionally require facilities for educational activities, examinations, events, maintenance, safeguarding, security, emergencies or other operational requirements.
Where reasonably necessary, NXT Level may relocate, reschedule or cancel a booking because a Facility has become unavailable.
NXT Level will provide as much notice as reasonably practicable and, where appropriate, will seek to offer a suitable alternative.
Where NXT Level cancels a booking and cannot provide a reasonable alternative, amounts already paid for the affected booking will normally be credited or refunded.
Nothing in these Terms removes any statutory rights a Customer may have where NXT Level is unable to provide a contracted service.
16. Outdoor Facilities and Weather
NXT Level or the School may close or restrict use of outdoor facilities where weather, ground conditions, maintenance, safety considerations or the risk of damage make use inappropriate.
The decision of authorised NXT Level or School staff as to whether a School owned outdoor Facility may be used must be respected.
Customers must not enter or use a pitch or outdoor Facility after being told it is closed.
Where NXT Level cancels an outdoor booking because the Facility is not reasonably usable, NXT Level will determine whether an alternative, credit or refund is appropriate in accordance with the booking circumstances and applicable law.
17. Food and Drink
All nut restrictions in Section 6 apply at all times.
Hot food, catering or food sales require prior written approval from NXT Level.
Customers providing or selling food must comply with applicable food safety, hygiene and licensing requirements.
Food, drink, crockery and associated rubbish must be cleared before departure.
Food and drink may be prohibited entirely from particular Facilities.
18. Licences and Permissions
Customers are responsible for obtaining any licence, permission, consent or approval required for their activity.
This includes, where applicable, music, performance, copyright, entertainment, food, sporting or other regulatory requirements.
Hiring a Facility does not constitute NXT Level or School approval of the Customer's wider organisation, activities or views.
NXT Level or School names, branding or logos must not be used in promotional materials without prior written permission.
19. Insurance
Customers must maintain insurance appropriate to their activities and associated risks.
NXT Level may require evidence of Public Liability Insurance and other appropriate insurance before permitting a booking to commence.
Customers must ensure their insurer is aware, where relevant, that activities are taking place at hired School premises.
Failure to provide required insurance evidence may result in suspension or cancellation of the booking.
20. Swimming Pool Hire
Customers hiring a swimming pool must comply with all site specific pool operating and emergency procedures made available to them.
Suitable qualified lifeguard provision must be maintained throughout the activity where required.
Evidence of relevant lifeguarding qualifications, insurance and risk assessments must be supplied when requested.
Outdoor footwear and items that have been in outside contact must not be taken poolside where prohibited by site rules.
Food is not permitted poolside.
Customers and Attendees must not access pool plant rooms, chemical storage areas, controls or other restricted areas.
Customers are responsible for maintaining appropriate participant supervision and any required lifeguard or instructor ratios.
NXT Level may stop an activity immediately where pool safety requirements are not being followed.
21. Storage
Equipment may only be stored onsite with prior written agreement.
Permission to store equipment does not transfer responsibility for that equipment to NXT Level or the School.
Customers should maintain appropriate insurance for stored property.
Dangerous, flammable, noxious or otherwise unsuitable materials must not be stored onsite.
NXT Level or the School may require stored items to be removed on reasonable notice, or immediately where they create a safety or safeguarding concern.
22. End of Hire
You and all Attendees must vacate the Facility and any associated areas by the confirmed end time.
Changing, packing away, clearing equipment and collecting participants must be completed within your booked time.
If additional time is regularly required, you must extend your booking.
Unauthorised additional use may result in additional hire or staffing charges reasonably reflecting the additional use and costs incurred.
Facilities must be left secure, clean and tidy.
23. Operational Issues and On Call Support
Any problem affecting access, safety or delivery of your booking should be reported to NXT Level as soon as possible so that we have a reasonable opportunity to resolve it.
During operational hours, customers should initially speak with the NXT Level member of staff onsite where available.
Urgent operational or access issues can be reported to the NXT Level on call team on 0203 011 3530.
Customers should not wait until after the booking to report an issue where it could reasonably have been raised and addressed at the time.
24. Suspension and Termination
NXT Level may suspend or terminate bookings where there is a serious or repeated breach of these Terms.
This may include failure to pay outstanding invoices, serious safeguarding concerns, failure to provide required compliance documentation, unsafe activity, abusive or threatening behaviour, serious or repeated unauthorised facility use, deliberate security breaches, illegal activity, serious nuisance to neighbours or repeated disregard of reasonable instructions from NXT Level or School staff.
Where the circumstances create an immediate safeguarding, health and safety, security or legal risk, NXT Level may stop an activity immediately.
Where the breach is capable of being remedied and does not require immediate action, NXT Level will act reasonably in determining whether a warning or an opportunity to rectify the issue is appropriate.
25. Damage, Loss and Customer Responsibility
Customers are responsible for the actions of their Attendees while attending under their booking.
Customers must immediately report damage to School or NXT Level property.
Where damage, loss or additional costs are directly caused by the Customer or its Attendees, NXT Level may seek reimbursement of the reasonable cost of repair, replacement or other loss, subject to applicable law.
Customers remain responsible for their own property and should not leave valuables unattended.
NXT Level and the School will not be responsible for loss of or damage to personal property except where liability cannot lawfully be excluded.
26. Liability
Nothing in these Terms excludes or restricts liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Subject to the above and applicable law, NXT Level will not be responsible for losses that were not reasonably foreseeable or that result from circumstances outside its reasonable control.
Nothing in these Terms affects any statutory rights which cannot lawfully be excluded or restricted.
27. Events Outside Our Reasonable Control
NXT Level may be unable to provide a Facility because of circumstances outside its reasonable control.
These may include severe weather, fire, flood, utility failure, emergency maintenance, School closure, security incidents, public emergencies, industrial action, government restrictions or other events which could not reasonably have been prevented.
NXT Level will notify affected Customers as soon as reasonably practicable and will act reasonably in determining whether the booking can be relocated, rearranged, credited or refunded, taking account of applicable law.
28. Changes to Bookings and These Terms
Changes to an individual booking must be agreed by NXT Level.
NXT Level may update these Terms from time to time to reflect changes in law, safeguarding requirements, School requirements or reasonable operational requirements.
Material changes affecting an existing booking or ongoing arrangement will be communicated appropriately and will not be applied retrospectively where doing so would be unlawful or unfair.
29. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure by NXT Level to enforce a provision on one occasion does not prevent it from enforcing that provision subsequently.
The Customer may not transfer its rights under a booking without NXT Level's prior written agreement.
These Terms and the booking documents referred to within them constitute the agreement relating to the Facility hire, except where alternative terms have expressly been agreed in writing.
Nothing in these Terms is intended to exclude or restrict rights that cannot legally be excluded.
30. Governing Law
These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights applicable to consumers.
